(Oral) Through instant petition, preferred under Article 226/227 of the Constitution of India, petitioners have sought issuance of a writ in the nature of mandamus directing the respondents to grant the pecuniary benefits to them as result of grant of deemed date promotion to late Hawa Singh, predecessor-ininterest of the petitioners. 2.

The contention of learned counsel for the petitioners is that Hawa Singh, predecessor-in-interest of the petitioners had moved representation dated 11.04.2016 (P-3) to the Executive Engineer, GWS Division, Gurgaon seeking deemed date promotion as Deputy Superintendent and Superintendent, which is under consideration of the respondents as per correspondence in between the officers of the department. Learned counsel for the petitioners submits that petitioners feel satisfied in case direction is issued to the concerned authorities to take a conscious decision on the representation earlier moved to the respondent(s) by Hawa Singh, their predecessor-in-interest and grant benefits to them. 4.

Without expressing any opinion on the merits of the case, instant petition is disposed of with a direction to respondent(s) to consider the claim of the petitioners and take a conscious decision on the representation earlier moved by Hawa Singh, within a period of three months from the date of receipt of certified copy of this order.

However, if the petitioners still feel aggrieved against any of the order(s) passed by the concerned authority, they shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
