***** HARKESH MANUJA J. (Oral) Prayer in this petition is for setting aside impugned order dated 04.08.2022.

Vide impugned order dated 04.08.2022 (Annexure P-9), the Rent Controller, Faridabad has directed the petitioner to deposit provisional rent to the tune of Rs.24,96,176/-, based on an admission made by the petitioner in para 5 of his written statement (Annexure P-3). The relevant part is reproduced as under:- "As per ledger account Rs.1,86,440/- remained unpaid in the financial year 2020-2021 and Rs.21,16,800/- remained unpaid in the financial year 2021-2022." It is the contention of the petitioner that the said admission has been wrongly made. However, unless the admission made in the written statement, reproduced above, is either withdrawn or got amended, the impugned order cannot be interfered with.

CR-3270-2022 --2-- seeks permission to withdraw the present revision petition with liberty to move an application before the learned Trial court seeking amendment of the written statement as well as move an application before the learned Rent Controller for recalling of the impugned order in the aforesaid terms. It is obvious that in case any such applications are filed, those shall be decided on their own merit.

In view of the above, the instant petition is disposed of as withdrawn with aforesaid liberty.
