Present petition under Section 482 Cr.P.C. for issuance of directions to respondents No.1 to 4 to take appropriate legal action against respondent No.5 for extending threats to the petitioner to build up pressure to compromise the matter in case FIR No. 08 dated 27.04.2018, registered under Sections 7 & 13(2) of the Prevention of Corruption Act, 1988 and Section 120-B IPC at Police Station Vigilance Bureau, Bathinda, District Bathinda.
Learned counsel for the petitioner contended that petitioner is a complainant in case FIR No. 08 dated 27.04.2018, but the police has not arrested the accused/respondent No.5, who was posted as Secretary, Market Committee, Punjab Mandi Board, Goniyana Mandi Office, District Bathinda; his petition for granting pre-arrest bail has also been dismissed by this Court vide order dated 17.05.2018, passed in petition i.e. CRM-M20983-2018 and he has not filed any petition before the Hon'ble Apex Court DEEPAK KUMAR BHARDWAJ 2019.08.22 13:59 I attest to the accuracy and integrity of this document
Criminal Misc. No. M-32144 of 2019 for granting him pre-arrest bail in the matter. Meanwhile, respondent No.5 has been threatening the petitioner to enter into a compromise and the police authority has also not entertained his request despite having made representation dated 16.01.2019 (Annexure P3). Notice of motion.
On asking of the Court, Mr. Ramandeep Sandhu, Senior Deputy Advocate General, Punjab accepts notice on behalf of respondents No.1 to 4. A complete copy of paper-book be provided to him during the course of the day.
In view of above, present petition stands disposed of with the directions to respondent No.2-Senior Superintendent of Police, Vigilance Bureau, Bathinda Range, Bathinda to look into the matter; take required action as regards to arrest of accused/respondent No.5 and also to look into the aspect of security threat to the petitioner.
