Learned counsel for the petitioner submits that the lower Appellate Court has wrongly declined the grant of ex parte injunction and issued the notice of the appeal as well as applications under Order 41 Rule 5 and Order 39 Rules 1 and 2 read with Section 151 CPC. Learned counsel for the petitioner submits that now the case is fixed for 19.10.2019 and the grievance of the petitioner before this Court is that respondents are not deliberately putting in appearance before the Lower Appellate Court and in this background, the applications are pending till date.

C.R No. 4621 of 2019 has submitted that on the next date of hearing i.e 19.10.2019, the Advocate will put in appearance on behalf of respondent Nos. 2 to 6, 7 (A) to 7 ( c). Keeping in view the above fact, the revision petition stands disposed of and a direction is given to the Appellate Court to conclude the proceedings on applications under Order 41 Rule 5 and Order 39 Rules 1 and 2 read with Section 151 CPC, within a period of one month starting from 19.10.2019 i.e next date.
