(Oral) As per the seniority list, one candidate namely, Ritin Kumar, who was at Sr. No.34, has been given appointment on account of nonjoining of the other selected candidate. The petitioner was placed at Sr.No.35 in the provisional list of successful candidates. As per notice dated 16.02.2016 (Annexure P-10 Colly), the candidates, who have not joined the duty within the specified period, the department has offered to cancel their appointments. The petitioner has received the RTI information dated 17.03.2016 (Annexure P-11 Colly), according to which, only one candidate has given reply to the said notice and one post of Social Studies is still available.

Keeping in view the fact that one post of Social Studies is still available, the present writ petition is allowed with the directions to the respondents-department to consider the claim of the petitioner and offer her an appointment, within a period of three months, from the date of receipt of certified copy of this order.
