(ORAL) Learned State counsel submits that in compliance of order passed by this Court directing the Department of Vigilance, Government of Haryana to look into the allegations with respect to forgery of certain documents on the basis of which claim is being raised in the present petition, a report has been submitted by the Department of Vigilance, Government of Haryana, which has also been forwarded to the Chief Secretary, Government of Haryana. Learned State counsel is requested that the said report be given to learned Senior counsel for the petitioner for information and necessary action. In the present case, Vigilance Department of State after investigation has already forwarded a report to the Government of Haryana, a copy of which report has also been forwarded to the Chandigarh Police. Since the matter is under investigation as of now to decide further course of action needed, present petition is disposed of with a direction that in case after the investigation, any

CWP No.28224 of 2013 (O&M) #2# right accrues to the petitioner to claim any benefit as claimed in the petition, he will be at liberty to either revive the present petition or file a representation with the respondent to claim the same or file fresh petition to claim the said benefits. Learned Senior counsel submits that in view of subsequent development, the present petition may be disposed of as having been not pressed with liberty to avail appropriate remedy, as per law so as to claim the benefit as prayed in this petition, in case, any right accrues to the petitioner after the completion of the investigation by the Chandigarh police. Ordered accordingly.
