* * * * S.J. VAZIFDAR, A.C.J. (ORAL) The petitioner apprehends that respondent No. 1 may not consider his bid as the fee for the tender form of ` 575/- was not received by respondent No. 1.

There is no rejection of the petitioner's bid. The petitioner only seeks an order directing respondent No. 1 to consider his representation to have his bid entertained and not rejected for the amount having not been remitted to respondent No. 1 due to no fault of his. Respondent No. 2 - the bank has by a certificate dated 26.11.2015 (Annexure P-4) admitted that the fault was on the part of respondent No. 2 and not the petitioner. 3.
The petition is, therefore, disposed of by directing respondent No. 1 to consider the petitioner's above representation especially in the light of the certificate issued by respondent No. 2 dated 26.11.2015 (Annexure P-4).

In the event of respondent No. 1 rejecting the petitioner's bid for want of the fee for the tender form of ` 575/-, the petitioner is at liberty to file a fresh writ petition.
