Versus

STATE OF HARYANA & ORS .....Respondents CORAM : HON'BLE MR. JUSTICE AMOL RATTAN SINGH

Present:

Mr. Naresh Kumar Kalia, Advocate for the petitioners.

Mr. Hitesh Pandit, Addl. A.G. Haryana.

*** AMOL RATTAN SINGH, J. (ORAL) By this petition the petitioners seek that their application forms for the post of Special Police Officers be accepted, pursuant to the advertisement dated 07.06.2016, they being those who were earlier selected for appointment as Constables in Haryana State Industrial Security Force, which was subsequently disbanded.

Though, those who had been selected for the said posts, i.e. Constables in the HSISF and had also been deputed for training, have been made eligible in the said advertisement for consideration for appointment as Special Police Officers, the petitioners have not been put into that category, on the ground that they were not sent for training even though they had been selected.

The same controversy came up in CWP-14601-2017, as regards the advertisement issued in the year 2017 (this year), also for appointment to the post of Special Police Officers, wherein upon notice having been issued, the Director General of Police, Haryana, had sent to the office of the SUNIL DEVI 2017.08.01 12:03 I attest to the accuracy and integrity of this document

CWP-24054-2016 -2Advocate General, a copy of the communication sent by him to various police officers, to the effect that those who had been selected for appointment as Constables in the HSISF, but had not been deputed for training would be also considered for appointment as SPOs along with those who had been so deputed for the training.

Learned State counsel on instructions submits that since the number of posts advertised in 2016 were not all filled up, and the remaining posts also being filled up along with the posts advertised in the year 2017, the same instructions of the Director General of Police would apply in respect of the remaining posts advertised in 2016. Consequently, the candidature of the petitioners, if otherwise found eligible, would not be rejected on the ground that they were not deputed for training pursuant to their selection as Constables in the HSISF (now disbanded).

In view of the above statement, this petition has been rendered infructuous and disposed of as such.

Since the selection process is ongoing and the petitioners apprehend that the post may be filled up, a copy of this order be given under the signatures of the Court Secretary to the learned counsel for the petitioners and it is directed that if the petitioners apply within one week, sufficient number of posts as are the other number of petitioners, would not be filled up till that date.
