Amol Rattan Singh, J The petitioner having remained in custody since 07.05.2018, with not even a single witness examined so far and the next date of hearing before the trial court being 15.11.2019, and 19 witnesses still to be examined, all of them being police officials, I see no reason to keep him in custody any further during pendency of the trial, with admittedly no other criminal case registered against him.
Consequently, though learned State counsel has opposed the grant of bail on the ground that the quantity of Ganja Patti stated to have been recovered from the petitioner and his co-accused is 45 kgs, with the AVIN KUMAR 2019.09.05 13:00 I attest to the accuracy and integrity of this document
CRM-M-31540-2019 [2] commercial quantity being above 20 kgs, in my opinion, the petitioner cannot be kept indefinitely in custody in the aforesaid circumstances, and therefore, without making any comment on the actual merits of the case for or against the petitioner, the petition is allowed and the petitioner is ordered to be released on bail, upon his furnishing bail bonds and surety bonds to the satisfaction of the trial court.
