DEEPAK GUPTA , J.(Oral) On 20.07.2023, the following order was passed by this Court:- "Prayer in this petition filed under Section 438 Cr.P.C is for grant of anticipatory bail to the petitioner in case FIR No.117 dated 01.06.2023 registered under Section 379 and under Section 411 IPC added later on, at Police Station Sadar Nabha, District Patiala.

As per the allegations, cable wire and starter of the motor of the complainant Jagdish Singh and various other villagers were stolen. While lodging of the FIR, role of Ladi and Jagpreet Singh was suspected. Both of them were arrested. Some recovery was effected. They disclosed that some of the stolen property had been sold by them to the petitioner. It is contended by learned counsel for the petitioner that petitioner is sought to be arrested only on the basis of disclosure statement of the co-accused which is inadmissible and that the petitioner is ready to join the investigation. Notice of motion.

Mr. R.S. Khaira, DAG, Punjab, accepts notice on behalf of the respondent - State. Copy of the petition be supplied to him during course of the day.

CRM-M-34645-2023 - 2 - Learned State Counsel does not refute the contention of learned counsel for the petitioner.

Let status report be filed by the respondent- State for 09.10.2023.

In the meantime, in case of his arrest, the petitioner shall be released on interim bail subject to the satisfaction of the Arresting Officer/ Investigating Officer. However, it is further directed that the petitioner shall join the investigation as and when so required by the Investigating Officer. He shall not contact any person associated with the case to dissuade him from the investigation in any manner whatsoever and nor shall leave the country without prior permission of the Court. He shall further comply with the conditions stipulated in Section 438(2) Cr.P.C." On instructions from ASI Ved Parkash, learned State counsel has informed this Court that the petitioner has joined the investigation, in compliance of the order dated 20.07.2023 and is no longer required for further investigation.

In view of the aforesaid, the order dated 20.07.2023, whereby the petitioner was granted interim anticipatory bail, is hereby made absolute. However, he shall continue to join investigation, if and so required by the Investigating Officer.

Disposed of.
