Petitioners have prayed for a writ in the nature of Mandamus to direct respondent No.2 to take appropriate action against respondents No.5 & 6 in view of the provisions of Sections 14(A) and 14 of the Haryana Municipal Act, 1973.
Counsel for the petitioners has vehemently argued that respondents No.5 & 6 have indulged in a number of criminal acts and certain FIRs are also pending against them. However, authorities have failed to act in accordance with law.
I have heard counsel for the petitioner.
Petitioners, who are Municipal Councillors, have levelled number of allegations against respondents No.5 & 6. According to them, FIRs are also pending regarding certain alleged offences committed by them. It is, however, not clear whether investigation in any of the FIRs has culminated or not. Petition is not only premature but appears to have been filed to settle political scores.
