IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CWP-20467-2019 (O&M) Date of decision : 17.08.2019 Kamla Devi ... Petitioner

Versus

State of Haryana and others ... Respondents

CORAM:

HON'BLE MR. JUSTICE AMIT RAWAL

Present:

Mr. S.K. Malik, Advocate for the petitioner.

**** AMIT RAWAL, J. (ORAL) Grievance of petitioner, in present writ petition, is that vide order dated 04.06.2019 (Annexure P-1), her services have been regularized w.e.f. 01.04.2011 and despite having entitled to all consequential benefits, the same have not so far been granted. In this regard, submitted representation dated 05.07.2019 (Annexure P-4), but there is no adherence thereto.

It is very strange that order dated 04.06.2019 (Annexure P-1) is not being implemented by the Department, despite having been represented. It is a case, where respondents are required to be jolted, to wake up from slumber and take action.

Without going into the merits and de-merits of the case, I dispose of the present writ petition with a direction to respondent Nos.3 & 4 to consider representation dated 05.07.2019 (Annexure P-4) and take

YOGESH SHARMA 2019.08.19 16:30 I attest to the accuracy and integrity of this document CWP-20467-2019 (O&M) appropriate decision thereon, in accordance with law, within a period of 45 days from the date of receipt of certified copy of this order. It is made clear that in case, decision is not taken within the time frame, there shall be costs of `25,000/- to be paid to petitioner. In case, the claim of petitioner is to be rejected, then a well reasoned and speaking order be passed and conveyed to petitioner.

This condition of imposing costs is only to prevent petitioner to run from pillar to post and avail remedy of contempt in case of non-compliance of directions issued by this Court. ( AMIT RAWAL ) JUDGE 17.08.2019 Yogesh Sharma Whether speaking/reasoned Yes/ No Whether Reportable Yes/ No
