The petitioner while serving as a Medical Officer had sought voluntary retirement and the prayer now made is to release the withheld 3 months' salary qua notice period which, as per stand of the department, was issued prior to completion of 20 years of service. At the time of hearing realising that the entire case is built upon interpretation of the relevant rule and the same having not been reproduced the case cannot proceed further, counsel prays for permission to withdraw the present petition to enable him to file a fresh one with correct particulars.
