(Oral) The challenge in this writ petition filed under Articles 226/227 of the Constitution of India, is to issuance of notification dated 27th November, 2003 (Annexure P-2) under Section 4 of the Land Acquisition Act, 1894 (in short 'the Act') and followed by the notification dated 24th November, 2004 (Annexure P-3) issued under Section 6 to the Act. According to the learned counsel for the petitioners, the award was announced on 22.11.2006 (Annexure P-6).

On a query being put to learned counsel for the petitioners that the writ petition is highly belated and why the writ petition be not declined on account of delay and latches, learned counsel for the petitioners, faced with this situation states that he may be allowed to withdraw the present writ petition with liberty to the petitioners to file a fresh writ petition seeking benefit of provisions of Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and JAWALA RAM 2016.02.16 16:52 I attest to the accuracy and authenticity of this document Chandigarh

CWP No. 2411 of 2016 - 2 - Resettlement Act, 2013 (hereinafter referred to as 'the Act of 2013'), as in respect of the award having been announced on 22.11.2006, no compensation has been paid to the petitioners so far and possession of the said land is still with the petitioners.

Dismissed as withdrawn. It shall, however, be open to the petitioners to claim benefit under the provisions of Section 24(2) of the Act of 2013, in accordance with law.
