G.S.SANDHAWALIA, J. (Oral) The petitioner seeks the relief of due date of promotion as officiating Assistant Sub Inspector on the ground that similarly situated junior persons have been granted the said benefit. The pleaded case of the petitioner is that he had joined the Police Department as Constable on 16.04.1994 and had qualified the Lower School Course and was promoted as regular Head Constable on 24.12.2001. While exercising the powers under Rule 13.21 of the Punjab Police Rules, 1934, respondent no. 2-DGP, Punjab on 20.02.2003 (Annexure P-2), had approved his name for admission to promotion list D-II (Exemptee) (Annexure P-2). The formal order was passed on 07.04.2003 (Annexure P3). The petitioner had gone abroad for 5 years on self employment leave and thereafter, rejoined the services on 26.11.2013.

In the interim period, the juniors were promoted as officiating Assistant Sub Inspectors and the details have been given in Annexure P-4 wherein, persons brought on the list D-II in the years 2004 to 2009 have been given the benefit. SHIVANI GUPTA 2015.12.

CWP No. 25080 of 2015 Counsel for the petitioners submits that for the redressal of his grievances, legal notice has been served upon the respondents on 11.07.2015 (Annexure P-10) but the same is pending consideration and he would be satisfied if a time bound decision is taken on the same. Notice of motion.

Mr. R.S. Sidhu, AAG, Punjab accepts notice on behalf of the respondents. Copy of the writ petition has been supplied to him in Court. Keeping in view the limited relief sought, this Court is of the opinion that there is no need for the respondents to file reply. Accordingly, without commenting on the merits of the case, this writ petition is disposed of with a direction to respondent no. 2 to decide the legal notice dated 11.07.2015 (Annexure P-10) within a period of 3 months from the date of receipt of certified copy of the order. Needless to say if the relief is to be denied, a reasoned order be passed and conveyed to the petitioner.
