(ORAL) By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to consider and decide the appeal preferred by her against order dated 10.11.2010, whereby the claim of the petitioner for treating the husband's duty for the period of suspension from 06.10.2008 to 01.01.2010 instead of leave of kind due, was rejected. 2.

At the very outset of the arguments, it has been fairly conceded by learned State counsel that claim set up by petitioner in the instant petition was considered by the respondent(s) and has since been accepted vide order dated 05.12.2017 (Annexure R-2/1) and the suspension period of the husband of petitioner has been ordered to be treated as duty period for all intents and purposes.

In addition to it, learned State counsel further submits that even sanction has already been accorded to grant the amount on account of leave encashment to petitioner accrued to her on account of demise of her husband Sh. Rai Sahib, Ex-Driver, vide order dated 15.01.2018. 4.

In view of the facts detailed above, instant petition has rendered infructuous and stands disposed of accordingly. However, in case, petitioner still feels aggrieved, she shall be at liberty to have recourse to the other remedies available under law as well as to approach this court.
