(Oral) At this stage, counsel for the respondent has given statement that he has no objection if the transfer application is accepted and petition under Section 9 of the Hindu Marriage Act i.e. HMA/300/2022, titled 'Parminder Singh Vs. Kiran' is transferred from the Family (Camp) Court, Batala, District Gurdaspur to the Court of competent jurisdiction at Phillaur, District Jalandhar.

Keeping in view the statement so made, by the counsel for the respondent, it is also essential to consider that there are two sons born from the estranged marriage, who are in the care and custody of the applicant. Even, applicant had filed petition under Section 125 of Cr.P.C., which was decided ex parte and despite order of maintenance, passed by the Court, the PREETI 2026.01.23 15:36 I attest to the accuracy and authenticity of this document

TA-800-2025 respondent has not made payment of maintenance and as such, the applicant was constrained to file an execution, which is pending before the Courts at Phillaur. Even, the distance between the two places is stated to be 120 kilometres.

Considering the aforesaid circumstances, together with the statement made by counsel for the respondent, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/300/2022, titled 'Parminder Singh Vs. Kiran' filed by the respondenthusband, stands transferred from the Family (Camp) Court, Batala, District Gurdaspur to the Court of competent jurisdiction at Phillaur, District Jalandhar. The requisite record of the aforesaid case be sent by the Family (Camp) Court, Batala, District Gurdaspur, to the District and Sessions Judge, Jalandhar.

Learned District and Sessions Judge, Jalandhar, shall assign the said petition to the Family (Camp) Court, Phillaur. Even, the parties are directed to appear before the Family (Camp) Court, Phillaur, within a period of one month from today onwards.
