By virtue of instant petition, preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ of mandamus directing the respondents to release the interest on the delayed payment of leave encashment, gratuity and provident fund.

At the very outset of the arguments, learned counsel for the petitioner submits that though petitioner moved representation dated 09.04.2018 (P-2) but till date no conscious decision has been taken. He further submits that petitioner feels satisfied in case direction is issued to respondent No.5 to decide aforesaid representation, within a stipulated period. 3.

Instant petition is disposed of with a direction to respondent No.5Executive Officer, Municipal Committee, Dhariwal to consider the claim of the petitioner with regard to grant of interest on delayed payment in the light of Sonika 2018.08.02 11:18 I attest to the accuracy and authenticity of this document Chandigarh

Randhawa vs. State of Punjab, 1997 (3) RSJ 318, within a period of two months from the date of receipt of certified copy of this order. In case, the concerned authority comes to the conclusion that petitioner is entitled to the claim put forth by him, to calculate the same and make the payment within a period of next one month.

However, if the petitioner still feels aggrieved against any of the order(s) passed by the concerned authority, she shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
