(ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in FIR No.84 dated 6.6.2020, under Section 61 of the Excise Act, registered at Police Station C-Division, Amritsar.
It is the case of the petitioner that as per FIR, 27 bottles containing 750/750 mls. illicit liquor and one bottle containing 570 mls. illicit liquor were found and the petitioner allegedly fled away from the spot. On 10.11.2020, this Court issued notice of motion to the State of Punjab and the learned State counsel sought time to seek instructions and RAJ KUMAR ARORA 2020.12.23 17:59 I attest to the accuracy and integrity of this document
CRM-M-35522-2020 (O&M) the petitioner was granted interim protection subject to his joining investigation and complying with the provisions of Section 438 (2) Cr.P.C. The contentions of the learned counsel for the petitioner were recorded in which he had submitted that it was a case where the police falsely implicated the petitioner because of the reason that earlier in this year the State of Punjab had witnessed trade of illicit liquor by which number of lives were lost and in order to cover up and to show that the police is taking action, police have started implicating people including the petitioner falsely in different FIRs.
Today, learned State counsel, on instructions from ASI Kulwant Singh, has stated that in pursuance of the order of this Court dated 10.11.2020, the petitioner has joined investigation and has fully cooperated with the investigation process. He has further submitted that the petitioner is no longer required for custodial interrogation. In view of above statement made by the learned State counsel, the present petition is allowed. Interim order dated 10.11.2020, is hereby made absolute.
