The prayer made in the present petition is for directing the respondents to consider the petitioner for promotion to the post of Clerk from the date of his juniors have been promoted.

Learned State counsel refers to paragraph No.16 of the reply filed by way of affidavit of the Deputy Commissioner State Tax, Amritsar Division, Amritsar, wherein it has been specifically stated that the petitioner stood at Sr. No.90 and none of his junior has been promoted. Since Manjit Kaur was at Sr. No. 64 while Satnam Singh at Sr. 58 of the seniority list, he has never been superseded. The seniority is maintained at Divisional level while he was not in the Jalandhar Division when Manjit Kaur was promoted. 3.
