SANDEEP MOUDGIL, J (ORAL) CRM-36990-2024 Prayer in the present application is for grant of interim bail to the applicant/petitioner for four weeks on account of her treatment being patient of TB and having severe chest infection extended into the lungs as well.

In compliance of order dated 23.09.2024, counsel for the petitioner has filed a medical status report of the petitioner by way of an affidavit of Iqbal Singh Dhaliwal, PPS, Superintendent, Central Jail, Faridkot, which is taken on record. Para Nos. 2 and 3 are relevant which reads thus:-

2. That the Hon'ble Court had directed to file the medical status report of Under trial Suman Panday aged about 30 years daughter of Shri Kant panday resident of village purana Fazilka Road Near Sewa Gas Agency ,Abohar, District Fazilka..

3. That the detailed Medical report received from Jail Medical Officer is reproduced as under: - "With reference to above cited subject and on the basis of medical assessment, and perusal of his medical record, it is hereby submitted That the said inmate is medically assessed today and is found to be medically stable and there is nothing to indicate any SHAM SUNDER 2024.10.22 09:47 I attest to the accuracy and integrity of this document

CRM-M-35824-2023 (O&M) -2imminent risk to her health and life. That she is a diagnosed case of post-tubercular chronic lung disease, wherein her lungs have become overly sensitive for asthmatic attacks. Her clinical condition has waxing and waning course, which needs to be managed on long term basis. That she was last consulted by expert doctors of chest and TB on dated 14/10/2024 at a medical camp organized at Faridkot jail and is being treated accordingly. That she is currently being managed in consultation with the specialist doctors attached with the higher referral centres and her present clinical condition does not warrant any hospital admission outside Faridkot jail. "(Copy of the Medical officer report is attached as Annexure R-1/T) Note- Note- She has two minor children named as Yashika (4 years 11 months at present) and Arshit (3 years 8 months at present) who are confined with her in this prison.

In view of the afore-said report, it is evident that the condition of applicant/petitioner is now stable and there is nothing to indicate any imminent risk to her health and life. It is actual a case of post-tubercular chronic lung disease.

In the light of above, learned counsel for the applicant/petitioner seeks withdrawal of the present application.

Prayer is accepted.

Dismissed as withdrawn.

CRM-M-35824-2023 The jurisdiction of this Court under Section 439 of Cr.P.C. seeking regular bail to the petitioner in FIR No. 18, dated 16.02.2021, under Sections 302 IPC, registered at Police Station Gidderbaha, District Sri Muktsar Sahib.

After arguing for some time, learned counsel for the petitioner prays for withdrawal of the present petition, at this stage. Prayer is accepted.

Dismissed as withdrawn at this stage.
