The petition has been filed inter alia seeking a writ of certiorari challenging condition no. 16.4 of advertisement 2/2023 dated 21.02.2023, and cancellation of petitioner's candidature due to the condition, if a candidate darkens more than one circle and smudges/scratches any place in any manner with eraser, nail blade, white fluid/whitener etc., his/her OMR sheet as well as candidature itself shall be cancelled. Further, a writ of mandamus has been sought seeking a direction to the respondents to consider the petitioner's candidature for the post of TGT Physical Education Aman Dua 2025.03.19 16:33 I attest to the accuracy and authenticity of this judicial document


 

 

in response to the aforesaid advertisement.

Learned State counsel has produced the petitioner's original OMR sheet, which shows he has erased one of the options against answer no. 26 by scratching the OMR sheet. A photocopy of the said OMR sheet has been retained on the case file as Annexure 'A'. He further contends that this Court has already decided the issue of validity of condition no. 16.4 of the instant advertisement vide judgment dated 06.07.2023, rendered in CWP14159-2023 titled Kavita Rani and others v. Haryana Staff Selection Commission, against which LPA No. 1057-2023 has also been dismissed by the Division Bench.

Apparently, the issue raised in the petition already stands decided against the petitioner.

The petition, accordingly, stands dismissed.
