* * * * S.J. VAZIFDAR, C.J. (ORAL) The petitioner had applied for the allotment of a plot under the defence category. The application was processed on the basis that the petitioner was eligible. However, by the impugned communication dated 30.01.2017, the respondents stated that the petitioner had applied in the category beyond his eligibility and, therefore, cancelled the allotment and sought to refund the earnest money. The petitioner has not responded to this letter.

Inter alia, on the issue of categories, there are judgements of this Court which require consideration. The ends of justice at this stage, therefore, would be met by directing the petitioner to respond to the letter dated 30.01.2017 and directing the respondents to take a fresh decision in the matter after considering all the averments in the petition as well as the judgements including of this Court and the orders of the Supreme Court.

The petition is accordingly disposed of.
