Through instant petition, preferred under Article 226 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to grant family pension along with interest @ 18% per annum on account of death of her son Sukhpal Singh Constable while on duty, in the light of judgment passed by this Court in CWP No.2371 of 2010, titled as "Harbans Lal v. State of Punjab and ors.", dated 31.08.2010 (P-5). AND further to count the daily wage service rendered by her son before his regularization as qualifying service for pension and other benefits as well as to release the gratuity.

At the very outset of the arguments, learned counsel for the petitioner submits that though petitioner moved representation dated 22.02.2018 (P-10) but till date no conscious decision has been taken. CWP No.18899 OF 2018 --2-- that petitioner feels satisfied in case direction is issued to respondent No.2 to decide aforesaid representation, within a stipulated period. 3.

Instant petition is disposed of with a direction to respondent No.2Director General of Police, Punjab Police Headquarter, Sector 9, Chandigarh to consider the claim of the petitioner and take a final decision on representation (P-10) in the light of judgment passed by this Court in CWP No.2371 of 2010, titled as "Harbans Lal v. State of Punjab and ors.", dated 31.08.2010 (P-5), within a period of three months from the date of receipt of certified copy of this order.

However, if the petitioner still feels aggrieved against any of the order(s) passed by the concerned authority, she shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
