Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.120 dated 02.06.2019 under Sections 406, 120-B, 409 and 420 IPC, registered at Police Station Adampur, District Hisar.

Notice of motion was issued. Learned State counsel appeared and contested the petition. On previous date, learned counsel for the complainant appeared but today, none has put in appearance on behalf of the complainant.

CRM No.M-31497 of 2019 -2From the record, I find that the FIR in the present case has been registered on the complaint of one Ramphal, who claimed that he had gone to sell his Sarson crop and petitioner had taken money from him on the pretext of excess weighing.

Vide order dated 25.07.2019, interim bail was granted to the petitioner and he was directed to join the investigation. Learned State counsel, on instructions from SI Mohan Lal states that the petitioner has joined the investigation but stated that he is not cooperating in the investigation and certain documents, particularly J-form of the complainant, is to be recovered.

Learned counsel for the petitioner states that petitioner is only Munim and not in custody of any J-form, which would be available with the commission agent.

In view of the above, the present petition is allowed. The order dated 25.07.2019, granting interim bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by conditions of Sections 438(2) Cr.P.C.
