Present writ petition is challenge to the order dated 10.01.2018 (Annexure P4), passed by the learned Presiding Officer, Industrial Tribunal, Jalandhar (hereinafter referred to as "learned Tribunal"), whereby application under Section 33C(2) of the Industrial Disputes Act, 1947 (hereinafter referred to as "the Act"), filed by the petitioner, was dismissed on the ground that no claim was raised in the application for ascertained amount.

Learned counsel for the petitioner contended that petitioner was claiming amount on account of overtime, which has been denied by the management on the ground that he was given leaves in lieu of overtime and as such no liability was due towards the management. In view of the above fact that there was no ascertained sum in favour of the petitioner making a ground for filing an application under Deepak Kumar Bhardwaj 2018.08.03 14:53 I attest to the accuracy and integrity of this document

Civil Writ Petition No. 18912 of 2018 Section 33C(2) of the Act and the same was rightly dismissed by the learned Tribunal vide impugned order dated 10.01.2018.
