The present petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to encash the cheque issued by the petitioner pursuant to the demand letter dated 17.03.2025 (Annexure P-1), with a further direction to the respondents to grant/release higher pension to the petitioner under the Employees' Pension Scheme, 1995, along with arrears and interest @ 18% per annum from the date of his retirement, besides all consequential benefits.

Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the judgments rendered by this Court in CWP No.29633 of 2026 titled as Hazara Masih Vs. The Employees Provident Fund Organization and others decided on 09.10.2025 and in CWP No.7181 of 2026 titled as Lakhwinder Masih and others Vs. The Employees Provident Fund Organization and others and connected matters decided on 21.04.2026. Learned counsel for the petitioner submits that the NISHA 2026.05.28 15.09 I attest to the accuracy and integrity of this document

CWP-16681-2026 -2petitioner would be satisfied in case a direction is issued to respondent No.2 to decide his representation dated 23.02.2026 (Annexure P-4) for encashment of cheque and for grant of higher pension, in the light of the aforesaid judgments, in a time bound manner.

On the asking of the Court, Mr. Rajesh Hooda, Advocate, accepts notice on behalf of the respondents. He submits that the representation dated 23.02.2026 (Annexure P-4) of the petitioner will be considered and decided by respondent No.2 by passing an appropriate speaking order in the light of the judgments of this Court in Hazara Masih and Lakhwinder Masih's case (supra).

In view of the discussion above, the present writ petition is disposed of with a direction to respondent No.2 to issue fresh demand notice to the petitioner within a period of four weeks from the date of receipt of a certified copy of this order. Upon issuance of the said demand notice, the petitioner shall deposit the demanded amount along with applicable interest within a further period of six weeks, thereafter.
