HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.58 dated 29.01.2017 under Sections 216,379-B,482 IPC registered at P.S Palam Vihar, Gurgaon.
FIR has been lodged on the complaint of one Vinod Rana, who alleged that on 29.01.2017 at about 8.15 pm, he was to leave for his home in his Fortuner car from Vyapaar Kendra Palam Vihar. Two boys came to him and one of them asked for keys of the Car while the another threatened the complainant to shoot. They snatched keys of the car along with mobile of the complainant and ran away. His purse and five credit cards along with ATM of various banks were lying in the car, which was taken away by them.
Learned counsel for the petitioner contends that as per investigation, name of the petitioner has cropped up in the disclosure statement of co-accused Sandeep that the petitioner had driven the car in which Sandeep & other co-accused had come.
The petitioner is in custody since 03.03.2017 and the trial is not making any headway due to Covid pandemic.

CRM-M-35959 of 2020 #2# On the other hand, learned State counsel points out that the petitioner is involved in four other cases including the one registered under Section 302 IPC. Investigation is complete in this case. Learned counsel for the petitioner states that the petitioner is on bail in all the four cases and has not been convicted in any of them. Without commenting anything on the merits of the case and having been cognizant of the fact that the outbreak of pandemic COVID-19 in the region may delay the conclusion of trial, in the opinion of this Court, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Ajit @ Bachhi is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
