Instant writ petition under Articles 226/227 of the Constitution has been filed for issuance of a writ in the nature of certiorari for quashing the order of assessment dated 01.10.2012 (Annexure P-5) under Section 135 Indian Electricity Act, 2003 (hereinafter referred to as 'the Act') whereby and amount of `1,47,081/- has been assessed against the petitioner as loss caused to the respondents and notice dated 01.10.2012 (Annexure P-6) vide which petitioner was given offer to compound the matter to absolve the petitioner from criminal liabilities RAVINDER SINGH 2015.10.28 13:18 I attest to the accuracy and authenticity of this document

-2CWP No.28433 of 2013 for committing theft of electricity under Section 135 of the Act. Further prayer has been made for direction to the respondents to refund the amount of `35580/-, which has already been deposited by the petitioner, along with interest @ 18% per annum.

I need not reproduce the facts of the case as the issue involved in this case has been dealt with by this Court in CWP No.4016 of 2014 titled 'Satyabir Goyal v. Dakshin Haryana Bijli Vitran Nigam and others' decided today.

The decision rendered in the case of Satyabir Goyal (supra) is fully applicable to the present writ petition. Resultantly, this writ petition is disposed of in the same terms.
