Case has been heard through video conferencing on account of COVID-19 Pandemic.

The petitioner has filed this writ petition seeking grant of increment for the service, which he had rendered continuously for a period of one year before he retired on 31st December, 2017. Learned counsel for the petitioner has submitted that the benefit of the said annual increment was withheld by the Department on the ground that it was due only on 1st January, 2018, by which date the petitioner attained the age of superannuation.

At this stage, Ms. Simran Grewal, AAG, Punjab accepts notice on behalf the respondents.

Learned counsel for the petitioner while relying upon judgment dated 29.1.2020 (Anneuxre P-4) passed by the Co-ordinate Bench of this Court has submitted that he will be satisfied if necessary directions are given to respondents No.2 & 3 to decide his representation dated 12th July, 2020 (Annexure P-1) in accordance with law within a stipulated period. The learned State counsel has no objection if such direction is given.

In the light of the aforesaid, without commenting upon merits of the case or about the entitlement of the petitioner for the relief which has been claimed by him in the representation dated 12.7.2020 (Annexure P-1), the present writ petition is disposed of with direction to respondents No.2 & 3 to decide his representation dated 12.7.2020 within a period of 3 months from the receipt of copy of this order.

In case, the petitioner is found entitled to get any monetary benefit after decision of the representation, the same should also be paid to him within 2 months thereafter.
