Present:

Ms. Riffi Birla, Advocate for the petitioner. HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.50 dated 22.04.2016 under Section 22 of NDPS Act registered at P.S Sadar Jalalabad, District Fazilka.

As per allegations in the FIR, 250 grams powder of Alprazolam was recovered from the possession of the petitioner. She was granted bail on 17.06.2016. Thereafter, she was regularly appearing before the trial Court. However, on one of the dates i.e 04.10.2019, she absented herself. It is the case of the petitioner that her non-appearance was not intentional. In fact, she had married one Jaswant Singh on 20.09.2019. Marriage was solemnized against the wishes of her parents. Since the petitioner and said Jaswant Singh apprehended threat to their life at the hands of petitioner's family, they had run away so as to hide themselves. It is only because of that reason that the petitioner could not appear on the date fixed. It is further stated that the petitioner had delivered a child on 16.10.2020. She is stated to be arrested on 11.07.2020. Notice of motion.

Having heard learned counsel for the parties and taking into account the circumstances of the present case particularly the fact that the petitioner has delivered a child, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Sunita Rani is ordered to be released on bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. She shall also file an undertaking before the concerned Court to continue appearing as and when required apart from following all the terms and conditions fixed in this respect.
