Mz.Sudeepti Sharma,DAG Punjab assisted by Mr.Pawan Kumar,Clerk O/O DEO(SE)Amritsar and Mr.Karamjit Singh,Lecturer, Math, SSSS Sudhar,Amritsar Jaswant Singh,J(Oral) The grievance of the petitioner, who is a Lecturer in English, is that inspite of his transfer order dated 27.10.2016 (Annexure P-5), transferring him from Amritsar to Gurdaspur, he is not being relieved by the District Education Officer/Principal concerned. Upon notice, learned State counsel points out that the complete translated copy of transfer order P-5 has not been appended.

She submits that the transfer orders were conditional subject to availability of staff in the relieving school to be at least 50% of the sanctioned strength and since the staff at SSSS Sudhar is below 50% of the sanctioned strength,therefore, the petitioner in terms of the transfer order P-5 is not entitled to be transferred out and in terms of transfer order P-5, the same is deemed to be cancelled. In view of the above,counsel for the petitioner prays for permission to withdraw the writ petition.

Dismissed as withdrawn.
