It is contended that petitioner is entitled to interest on delayed payment as his retiral benefits were withheld on account of charge-sheet in which petitioner has ultimately been exonerated. Reliance is placed on judgments of this Court in S.K.Punchhi v. State of Haryana and another, 201491) SCT 707 and Dr. Mrs. Amrita Bhardwaj v. State of Haryana and others, 2014(3) SCT 209 as well as Nek Ram Sharma v. State of Punjab and others, 2015(3) SCT 622. CWP No.25299 of 2015 [2] avail. At this stage, it is prayed that respondents be directed to decide petitioner's representation Annexure P3 in a time bound manner. Keeping in view the limited prayer, facts and circumstances of the case but without expressing any opinion on the merits of the controversy, this writ petition is disposed of with a direction to the competent authority to expeditiously decide representation dated 07.09.2015 Annexure P3, by passing a speaking order, preferably within a period of four months from the date of receipt of a certified copy of this order. In case petitioner is found entitled for the interest on delayed payment, same be released within a period of six weeks thereafter.
