RUPINDERJIT CHAHAL, J. (ORAL) Prayer in the instant petition filed under Section 528 of BNSS read with Article 226 of the Constitution of India, is for issuance of direction to the trial Court for speedy disposal of the complaint registered vide No.COMI/28/2025 under Sections 109, 115(2), 118(1), 303(2), 351(2) (3), 3(5) of Bharatiya Nyaya Sanhita, 2023 pending before learned SubDivisional Judicial Magistrate, Sultanpur Lodhi. Learned counsel for the petitioner submits that the petitioner had filed the aforesaid application titled as 'Jagjit Singh vs. Neeraj Sethi & Anr.' . He submits that after hearing learned counsel for the complainant, learned Trial Court directed that a complaint under the aforesaid Sections be presented for registration and further directed the State to submit status report. He submits that matter was listed on various subsequent dates, however despite repeated adjournments, the status report from the PUNEET SHARMA 2026.05.29 18.05 I attest to the accuracy and authenticity of this order/judgment

CRM-M-31340-2026 -2concerned authority has not yet been received. He further submits that the learned Trial Court is not passing any effective order in this regard and therefore, the complaint is still pending without any substantial progress or final outcome. He further submits that appropriate directions be issued to learned Trial Court to dispose off the complaint expeditiously. Since the aforesaid complaint is pending adjudication before the trial Court since the year 2025 and speedy trial is a fundamental right of the petitioner enshrined under Article 21 of the Constitution of India, it would be in the interest of justice if the concerned Court is directed to decide the complaint moved by the petitioner expeditiously. Accordingly, the present petition is disposed of with a direction to the concerned Court to make earnest efforts to decide the complaint of the petitioner expeditiously, strictly as per law. Disposed of accordingly.
