CORAM: HON'BLE MR. JUSTICE AMOL RATTAN SINGH Present:- Mr. R.A.Sheoran, Advocate, for the petitioner. Mr. Munish Sharma, AAG, Haryana.

***** AMOL RATTAN SINGH, J. (Oral) By this petition, the petitioner seeks the concession of 'regular bail' under the provisions of Section 439 Cr.P.C., upon FIR No.628, dated 24.09.2018, having been registered at Police Station Dadri Sadar, Distrcit Charkhi Dadri, alleging therein the commission of offences punishable under the provisions of Sections 302/34 of the IPC. The petitioner having been admitted to interim bail vide an order passed on December 04, 2020, in view of the fact that at that stage he had been in custody for two years, but with the trial not having progressed, thereafter the interim orders were continued as even then a large number of prosecution witnesses still remained to be examined.

Today, learned State counsel submits that, as per his instructions from SI Narinder Singh, 11 prosecution witnesses out of 21 have been examined, including the complainant in the FIR, with there being no other material witness stated to be examined, other than police officials etc.. CRM-M-35837-2020 -2That being so, without making any comment on the actual merits of the case, the petition is allowed, with the interim order dated 04.12.2020, made absolute, on the same terms and conditions.
