Through the present petition filed under Section 438 Cr.P.C. the petitioner seeks the grant of anticipatory bail in FIR No.0370 dated 24.10.2020 registered under Section 61 of the Punjab Excise Act, 1914 at Police Station Sadar Fazilka, District Fazilka. Briefly stated, the case of the prosecution is that that on receipt of secret information a raid was conducted at the petitioner's house leading to the recovery of 84 bottles of illicit liquor. Learned counsel for the petitioner contended that the petitioner has been falsely implicated in the case; there is no other criminal case in which the petitioner is involved; no recovery has been effected from the petitioner; the alleged recovery from his house has been foisted upon him; nonetheless now no recovery is required to be made from him and that RAVINDER SINGH 2020.12.25 12:44 I attest to the accuracy and integrity of this document

-2CRM-M-35859 of 2020 under the interim orders passed by this Court the petitioner has not only joined the investigation but has also fully co-operated with the investigating agency.

Learned State counsel submitted that the petitioner has joined the investigation; he has co-operated with the investigating agency and that his custodial interrogation is not required. Keeping in view the above facts and in particular the afore statement made by learned State counsel as also for the reason that the petitioner is not involved in any other criminal case, the order of this Court dated 04.11.2020 granting ad-interim anticipatory bail to the petitioner is made absolute.
