Service is waived, Mr. Shekhar Verma, learned counsel having accepted notice on behalf of the respondents. The learned counsel appearing on behalf of the respondents states that in the facts and circumstances of the present case, the second appellate authority, namely, the Board will pass a fresh order after hearing the petitioner. 2.
The petitioner shall in the first instance appear before the Board on 18.09.2017 at 11.00 AM and thereafter as directed by the Board. In the event of the Board not sitting on 18.09.2017, the petitioner shall be informed the next date in writing.

The petitioner's undertaking to remove the violations which are non-compoundable is accepted and it is so ordered. No coercive steps shall be taken by the respondents till the decision of the second appellate authority, namely, the Board and for a period of four weeks thereafter. However, the petitioner shall maintain status quo in respect of the premises in question and shall not alienate, dispose of, encumber or part with possession thereof without the written consent of the respondents.
