(Oral) At this stage, counsel for respondents No.1 and 2, has given a statement that the said respondents have no objection, if the transfer application is accepted and the petition filed at the instance of respondents No.1 and 2, which is pending in the Courts at Chandigarh, copy whereof is Annexure A-2, is transferred to the Courts at Ambala, where the other petition, filed at the instance of the father of deceased-Sunil Kumar, is already pending, copy whereof is Annexure A-1. On query by this Court, it is submitted that both the claim petitions are pending at the stage of filing of reply. Both the claim petitions, as evident from Annexures placed on record, are relating to the PREETI 2025.12.05 15:59 I attest to the accuracy and integrity of this document
TA-810-2025 (O&M) compensation, sought on account of death of Sunil Kumar. The petition pending in the Courts at Ambala, copy whereof is Annexure A-1, which is filed by the father of the deceased, is earlier in time, whereas Annexure A-2, which is pending in the Courts at Chandigarh, has been filed by widow and son of deceased Sunil Kumar.
In view of the aforesaid fact situation and also considering the statement made by the counsel for respondents No.1 and 2, the transfer application is hereby accepted and the claim petition bearing No.MACP464-2024, titled as 'Neha Rani & Anr. Vs. Ranjeet & Ors.', copy whereof is Annexure A-2, stands transferred from the Courts at Chandigarh, to the Court of competent jurisdiction at Ambala. The requisite record of the claim petition be sent by the Court concerned at Chandigarh, to the District and Sessions Judge, Ambala.
Learned District and Sessions Judge, Ambala, shall assign the said petition, to the Tribunal, where the claim petition filed at the instance of the father of the deceased-Sunil Kumar, copy whereof is Annexure A-1, is already pending.
