Learned counsel for the petitioner submits that respondent no.2 has been wrongly impleaded as proforma respondent vide impugned order dated 02.05.2022 (Annexure P-7). Reference is made to petition under Section 11 of the Punjab Village Common Lands (Regulations) Act, 1961 (Annexure P-3), filed by respondent no.2 and others, which was dismissed in default on 06.09.2021 (Annexure P-4) by respondent no.1. It is submitted that respondent no.2 in view of the above, should not have been permitted to be impleaded as a respondent. If at all, respondent no.2 is at liberty to pursue the said matter and cannot be permitted to agitate in the present proceedings in an oblique manner. Learned counsel for the petitioner is unable to deny that the argument as raised above was never agitated before the learned Collector, Patiala.

In this view of the matter, learned counsel for the petitioner seeks to withdraw this writ petition with liberty to the petitioner to avail the remedy/remedies as may be available to the petitioner in accordance with law.
