)) + %   Present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of Mandamus directing the respondent no.2 to decide the representation filed by petitioner on 28.10.2020 (P88) in respect of advertisement no.05/2019 for direct recruitment for 4858 posts of Clerk Group8C; to stay the appointments made pursuant to above mentioned advertisement; and to direct respondent no.2 to include the roll number of petitioner in the final result dated 03.09.2020. At the outset, instead of pressing the petition on merits, learned counsel for petitioner submits that petitioner would be satisfied in case his representation dated 28.10.2020 (P88) is decided by the competent authority/respondent no.2 on some early date. Prayer seems to be justified.

CWP-18613-2020 -2Mr. Sharad Aggarwal, AAG, Haryana accepts notice on behalf of respondents and he is not averse to the innocuous prayer made by petitioner.

In view of the agreed stand taken by both sides, but without going into the merits of the case; this Court deems it appropriate to dispose off the present writ petition with direction to respondent No.2 to consider and decide the representation dated 28.10.2020, if the same is pending, by passing a speaking order in accordance with law, expeditiously, but not later than three weeks from today. Ordered accordingly.

Needless to say that if some adverse decision is taken against petitioner, he would be at liberty to take recourse to the remedy available under law.   , -.
