In the present writ petition, the petitioner has challenged the notice of premature retirement dated 21.04.2026 (Annexure P-1), order dated 23.04.2026/24.04.2026 (Annexure P-2) and adverse remarks recorded in the ACR of the petitioner for the period from 18.09.2023 to 03.03.2024 conveyed vide communication dated 06.02.2025 (Annexure P-6). The petitioner has also challenged the order dated 28.05.2025 (Annexure P-8) vide which, the representation submitted by the petitioner against the said adverse remarks recorded in his ACR, has been rejected. 2.

A perusal of the facts of the case would show that the petitioner has challenged the notice of premature retirement dated 21.04.2026. show that a Government employee who has been served with a notice/order of premature retirement, under the said instructions, may submit a representation to the competent authority.

Learned senior counsel appearing on behalf of the petitioner submits that in light of the above said instruction, the petitioner intends to file a representation before the competent authority against the order/notice of premature retirement. As such, the petitioner may be permitted to withdraw the present writ petition with liberty to file a representation before the competent authority against the order of premature retirement dated 23.04.2026/24.04.2026 (Annexure P-2) 4.

Learned senior counsel also submits that liberty may be granted to the petitioner to file a separate writ petition challenging the adverse remarks recorded in his ACR which was communicated to the petitioner on 06.02.2025 (Annexure P-6).

In view of the above, the present writ petition is dismissed as withdrawn with liberty as prayed for.
