Petitioner Balbir Singh, defendant in the civil suit titled 'Diwan Singh versus Balbir Singh' pending in the Court of Sh. Puneet Mohinia, Civil Judge, Junior Division, Chandigarh is aggrieved by the slow pace of trial and has approached this Court by way of filing the present petition under Article 227 of the Constitution of India for issuance of necessary direction to that Court for expeditious disposal of the civil suit, now pending for 6.10.2021. Of course, expeditious trial is right of every litigant since it is said that "justice delayed is justice denied".

Though the fact cannot be lost sight of that on account of unprecedented situation arising due to outbreak of Covid-19 the functioning of the Courts has been adversely effected but even then earnest efforts should be made to dispose of the cases in a prompt and expeditious manner. Therefore, the petition is disposed of directing the trial Court of Sh. Puneet Mohinia, Civil Judge, Junior Division, Chandigarh to ensure that the PARVINDER SINGH 2021.09.

Civil Revision No. 2172 of 2021 case in question is finally disposed of within a short time. In case the petitioner still feels dissatisfied by the pace of the proceedings then he may approach the learned District and Sessions Judge, Chandigarh in the matter, who would then look into the same and issue necessary directions to the Court concerned.
