Jaswant Singh,J(Oral) Petitioner, who belongs to Scheduled Caste (Ramdasia and others) category and also to the Ortho Physically Handicapped Category competed for the post of Clerk and Clerk-cum-Data Entry Operator in both the categories by submitting separate application forms. He is shown to have secured 54.04% marks in the merit position uploaded at P-4. His grievance is that in the subsequent merit list uploaded at Annexure P-5, persons namely Usha Rani, Thakur Singh,Suresh Kumar, Gurjit Singh and Satgur Singh, with lesser merit than petitioner have been included in the category of Scheduled Caste(Ramdasia and others)while the name of the petitioner stands excluded for no rhyme or reason. Vide order dated 28.11.2016 notice of motion was issued and it was directed that one post of Clerk/Clerk-cum-Data Entry Operator in the category of Scheduled Caste(Ramdasia and others)shall be kept in abeyance.

At the time of hearing today, learned State counsel has produced a copy of recommendation dated 2.12.2016 made by Secretary, Rajinder Parshad Joshi 2016.12.17 14:26 I attest to the accuracy and integrity of this document

CWP 24474/2016 Subordinate Services Selection Board,Punjab to Director,Department of Ayurveda,Punjab, wherein it is stated that name of Ms.Manjit Kaur in the category of Scheduled Caste(Ramdasia and others) is withdrawn and name of petitioner-Gurmukh Singh in the said category is recommended for recruitment. The said recommendation is taken on record as Mark-A. In view of the recommendation Mark-A,learned State counsel submits that present writ petition has become infructuous. Faced with this situation, learned counsel for the petitioner concedes that the present writ petition has become infructuous and needs no further adjudication in the matter.

Dismissed as having become infructuous.
