The present contempt petition has been filed for deliberate and intentional disobedience of order dated 19.10.2024 passed by this Court in CWP-26580-2023.

This Court had issued the following order in CWP-26580-2023, vide its order dated 19.10.2024:- "44. The present petition is accordingly allowed in light of the observations made above and by imposing a cost of Rs.5 lakhs on the Railways to be deposited with the PGIMER Poor Patients' Welfare Fund, Chandigarh and a further cost of Rs.1 lakh to be paid to the petitioner. The respondent Railways shall be at liberty to effect recovery of the same from the official(s) found responsible for the lapse. They are further directed to
-2take steps to provide an alternative passage to the petitioner or to pay admissible compensation, as per law, for infringement of rights of the petitioner. Let the needful be done within 06 months of receipt of a copy of this order."

In compliance of the order dated 19.10.2024 passed by this Court in CWP-26580-2023, compliance report by way of affidavit dated 17.09.2025 of Mr. Agya Pal Singh, Senior Divisional Engineer-I, Ferozepur, along with Annexures R-1 to R-7, has been filed on behalf of respondent No.2 before the Registry. The same is taken on record. The relevant portion of the said compliance report is reproduced as under:- "i.
As the worthy Deputy Commissioner is the competent authority for the process of Land acquisition, DC Kapurthala was initially approached for necessary procedure of land acquisition. However, DC Kapurthala had directed the Railways to follow the due process under The Railways Act, 1989. The Copy of the Official Letters dated 29/04/2025 and 12/05/2025are annexed as Annexure R-4 and R-5 respectively. Therefore, the process for land acquisition was since followed under relevant paras of The Railway Act, 1989 instead of Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Following guidelines at para 20(E) of The Railways Act, 1989, for declaration of acquisition of land i.e., (1) Where no objection under sub-section (1) of section 20D has been made to the competent authority within the period specified therein or where the competent authority has disallowed the objections under sub-section (2) of that section, the competent authority shall, as soon as may be, submit a report accordingly to the Central Government and on receipt of such report, the Central Government shall declare, by notification, that the land should be acquired for the
-3purpose mentioned in sub-section (1) of section 20A. Consequently, the copy of Official Notification/Paper Cutting is annexed as Annexure R-6. The said land parcel has now been acquired by the Central Government and information for its usage has also been communicated to Smt. Sandeep Saini (Petitioner) on 27.08.2025. The Letter written to the Writ Petitioner dated 27/08/2025 is annexed as Annexure R-7." 4.
A perusal of the above shows that the order dated 19.10.2024 passed by this Court in CWP-26580-2023 has been complied with, which is not disputed by learned counsel for the petitioners. 5.
In view of the above, since order dated 19.10.2024 passed by this Court in CWP-26580-2023, has already been complied with, therefore, the present contempt is purged and rule stands discharged. 6.
Needless to say that the legal representatives of the petitioner are at liberty to avail remedy as is available to them in accordance with law for any further relief.
