The present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to release the arrears of revised pay scale w.e.f. 01.01.2016 to 30.11.2018 in view of the approval granted by respondent No.2 in the 258th meeting dated 17.12.2018 (Annexure P-4) and 268th meeting dated 15.12.2020 (Annexure P-5) for implementation of the 7th pay commission along with interest @ 18% per annum from due date till realization. Further, for directing the respondents to re-fix the pay and consequential grant the revised retiral dues i.e. gratuity, leave encashment in view of the approval granted by respondent No.2 for implementation of the 7th Pay Commission along with interest @ 18% per annum. Further, to decide the legal notice dated 22.04.2026 of the petitioners by passing a speaking order in some time bound manner (Annexure P-10).

Learned counsel for the petitioners submits that he would be satisfied if the legal notice (Annexure P-10) of the petitioners is decided by respondent No.3 by passing a speaking order in a time bound manner. 3.

Learned counsel appearing on behalf of respondents No.2 & 3 submits that he has no objection in case a direction is issued to respondent No.3 for time-bound consideration and decision of the legal notice of the petitioners by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioners, respondent No.3 is directed to consider the legal notice (Annexure P-10) of the petitioners and pass a speaking order, after affording them an opportunity to be heard, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioners are found entitled to the relief sought, the same shall be granted forthwith by respondent No.3.
