The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of communication/show cause notice dated 06.05.2026 (Annexure P-1) issued under Section 59(2) of the Haryana Registration and Regulation of Societies Act, 2012 (for short '2012 Act') whereby functioning of the petitioner-Society has been stayed. 2.

The petitioner-Greenopolis Welfare Association was registered on 23.05.2013 under the Societies Registration Act, 1860 with the Registrar of Societies, District East Government of NCT Delhi for the project

-2- 'Greenopolis' situated at Sector 89, Gurugram. Subsequently, two societies namely (i) Greenopolis Welfare Confederation i.e. petitioner herein and (ii) Greenopolis Residents Welfare Association (for short 'GRWA') came to be registered on 04.12.2022 and 21.12.2024 respectively under the provisions of 2012 Act. Respondent No.3-State Registrar of Soceities, Haryana in the case of D-Pocket RW & DA vide order dated 08.04.2026 observed that operation of petitioner-Society overlaps with aforementioned second society. There cannot be more than one society for a single housing project whereas both the Societies are registered for the same project i.e. 'Greenopolis, Sector 89, Gurugram'. State Registrar of Societies, Haryana vide memo dated 26.02.

2026 received a letter from District Registrar, Gurugram to decide petition under Section 59 of 2012 Act regarding cancellation of registration of 'Greenpolis Welfare Confederation, Sector 14, Gurugram' and 'Greenpolis Residents Welfare Association, Village Hayatpur, Sector 89, Gurugram'. District Registrar, Gurugram vide memo dated 16.04.2026 was directed to send reference in the matter which was submitted vide memo dated 04.05.2026. On the basis of report dated 04.05.2026, the State Registrar of Societies, Haryana vide impugned show cause notice dated 06.05.2026 has called upon the petitioner to show cause as to why its registration should not be cancelled. Respondent No.2 has further stayed working of the Society. Impugned communication dated 06.05.2026 has been issued in pursuance to the inquiry report dated 04.05.2026.

As per petitioner's claim, it has neither been officially served with inquiry report dated 04.05.2026 nor communication dated 06.05.2026.

Said communication has been issued at the behest of Greenopolis Welfare

-3Association whose registration is under challenge before the Delhi High Court.

Learned Senior counsel for the petitioner submit that State Registrar of Societies, Haryana by impugned show cause notice has stayed working of the Governing Body and further directed that Society will not carry any activity regarding the handing over process till the final decision of the petition. Section 59 of 2012 Act permits to conduct inquiry and pass an appropriate order, however, there is no provision to suspend working of the Governing Body. The petitioner was not registered few days or few months back. Question of validity of registration is involved which was granted by respondent. The petitioner has elected Governing Body and further complied with provisions of 2012 Act. 4.

Learned Senior counsel for caveator-respondent No.2 submits that petitioner may be directed to file reply within notified period and Authorities may be directed to pass a final order within two weeks from the date of filing reply.

Learned State counsel submits that petitioner may file reply within period notified in the impugned show cause notice and competent authority would pass an appropriate order within 2 weeks from the date of filing reply. The petitioner would be supplied relied upon documents. 6.

In the wake of statements of all the stakeholders, the petition stands disposed of with a direction to respondent No.2-State Registrar of Societies, Haryana to supply to the petitioner copies of memos dated 26.02.2026, 16.04.2026 and 04.05.2026 along with annexures, if any, as discussed in impugned show cause notice, within two days from today. For

-4the said purpose, the petitioner through its authorized representative shall visit office of respondent No.2 and collect the said documents. Thereafter, the petitioner shall file its reply to the show cause notice dated 06.05.2026 within the period notified therein. Respondent No.2-State Registrar of Societies, Haryana, after granting opportunity of hearing to the petitioner as well as caveator, shall pass final order within two weeks from the date of filing reply. Both the parties are at liberty to raise all the issues including legal issues before the State Registrar of Soceities, Haryana. 7.

In the meantime, the Governing Body of the petitioner-Society shall be free to continue its working.
