-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of regular bail in case having FIR No.322 dated 10.7.2022 registered under Sections 398, 401 IPC at Police Station City Mandi Dabwali District Sirsa.

Satyawan father of petitioner submitted that the petitioner has been falsely implicated in the present case and petitioner is in custody since 10.7.2022. It is further submitted that recovery of iron rod has already been effected and similarly situated co-accused have been granted concession of regular bail vide orders dated 28.9.2022, copies of the same have been produced today in the Court and same are ordered to be taken on record. ( 2 ) CRM-M-38102-2022 On instructions from ASI Suresh Kumar, it appears that the petitioner was arrested from the spot on 10.7.2022 and at that time one iron rod was recovered from the possession of petitioner and after completion of investigation challan has been presented and that similarly situated coaccused are already granted concession of regular bail. In view of the above, since the similarly situated co-accused have already been granted concession of regular bail and recovery of iron rod has already been effected from the present petitioner, moreover challan has already been presented in the present case and it will take time for the trial to conclude, so no purpose is going to be served by keeping the accused behind the bars for any longer period. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
