Rival contention of the petitioner and private respondents is that their inter se merit has not been considered while offering appointments against the concerned posts. On the other hand, stand of the State is that petitioner failed to join within the stipulated period given in the appointment letters. As a result appointment was offered to next eligible candidates. The point of controversy, however, remains whether petitioner was properly notified and was given sufficient time to join at the place where he was sought to be posted. It appears that another opportunity was also granted to the petitioner to join his posting. The issue whether he reported pursuant to same and was entitled to be appointed, also needs to be considered.
