The petitioner has filed the present petition for grant of prearrest bail in a criminal case arising from FIR No. 4, dated 07.05.2020, registered under Section 307, 452, 326, 324, 323 & 34 IPC, at Police Station Sadar Gurdaspur, District Gurdaspur, without filing an application before the Court of Sessions.

The Sessions Court has a parallel jurisdiction under Section 438 Cr.P.C. As per practice, the accused is required to first file an application for grant of pre-arrest bail in the Court of Sessions. Hence, the petitioner is relegated before the Court of Sessions.

With the observations made above, the present petition is disposed of.
