IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 20957 of 2017 Date of decision: 06.12.2017 Suman ....Petitioner(s)

Versus

State of Haryana and others

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. Parminder Singh, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) The petitioner seeks consideration for appointment to the post of Primary Teacher (PRT) after exempting her from passing the Haryana Teachers Eligibility Test.

Counsel could not point out on what basis she has such legal right. The advertisement is also dated 08.11.2012 (Annexure P-7). A perusal of the advertisement would go on to show that it is the requirement which has been fixed by the Selecting Body. It is settled principle that the essential qualifications are based on the statutory rules of the Appointing Authority. Merely because the petitioner is physically handicapped, she would not as such have an absolute right for appointment having not acquired the basic essential qualification.

Resultantly, there is no merit in the present writ petition and the same is dismissed in limine.
